Legal Writing – Tips for Getting Started (?!@!)

If you are like most folks, the worst part about writing something is getting started.  Now I know that all of you who attended the Legal Writing seminar are the over-achieving type, so you are probably 1/2-way through by now, but I just wanted to give you a leg up if you are having trouble starting.  Here are some things to consider (but not obsess about):

  • What is your purpose? Objective or subjective?  Formal or informal?  Persuasive or informative?
  • Who is your audience? The court?  Your boss?  Your trainer?
  • Make an outline. This can help you to start organizing your thoughts.
  • Revise your outline and add detail. This can help you move into the writing process without even trying.
  • Just dive in!!! The Memorandum will not write itself!!  (It is time for tough love at this point!)
