Paralegal Essentials – Tort Law (Part 1)

A tort (not a torte), is a civil wrong.  This is a concept which comes down to us from the English Common Law.  A tort involves a wrongful injury to a person or his or her property.  There are essentially 3 theories of liability for tortious conduct:

  1. Intentional
  2. Negligent
  3. Strict Liability

Each theory includes several different torts as well as defenses to each of those torts.  The following is a non-exhaustive list:

Intentional Torts

  • Assault
  • Battery
  • Trespass to Land
  • Trespass to Personal Property
  • Conversion
  • Defamation
  • Fraud
  • False Imprisonment
  • Intentional Infliction of Severe Emotional Distress (IISED)
  • Invasion of Privacy

Negligence

  • Negligence
  • Premise Liabilit
  • Negligent misrepresentation
  • Negligent infliction of emotional distress

Strict Liability

  • Product Liability
  • Ultra hazardous activity
