Paralegal Essentials – Discovery (Basics)

If you are working on your paralegal education or just looking to review, here are some things which a California Paralegal should know about discovery:

  • Both parties and non-parties can be made to participate in discovery
  • Discovery can be used at almost every stage of litigation
  • Discovery is intended to clarify the legal issues
  • Discovery is intended to narrow the factual issues
  • Discovery is useful for improving or facilitating trial preparation
  • Discovery can help a party to evaluate and face the hard realities of their case
  • Discovery can help ensure that all the necessary parties have been brought into the action
  • Discovery can improve the presentation of evidence at trial
  • Discovery can eliminate surprise at trial
Knowing what discovery is designed to accomplish and its purpose in the process can help the lawyer and/or paralegal to be more effective in drafting and responding to discovery.
